		<description>Each person has his or her own definition of "fair", but it's certainly legal.  

Since states contribute to their higher education systems, it seems reasonable that out of state students pay a higher tuition since they didn't pay into the state taxes that are subsidizing the schools.

Everyone entitled to a college education?  Or a FREE college education?  Anyone who can get admitted to college can get a degree, but they might have to work to earn the money to do it, there is no entitlement to a FREE college education.&lt;br&gt;&lt;b&gt;References : &lt;/b&gt;&lt;br&gt;</description>

As for fair and proper use, one could argue that in fact, even those folks without kids benefit by the subsidy.  An educated workforce (which is what you get through the higher education system) is more productive and contributes to higher standards of living.  These higher earnings and standards of living benefit all residents by keeping money in state, contributing to higher wages across the board and further contributing to either increased personal/property tax receipts or (if the extra tax receipts aren't needed) lower tax rates.  College educated workers over a lifetime make twice as much as high school educated workers.
